🧾 Not Tested: We did not use CapCut for this page. Whether it is banned is settled by documents, not by running the app, so everything here comes from the linked sources as captured on 9 October 2026.

Who operates CapCut in the US, per its own Terms

CapCut’s US Terms, last updated 15 April 2026, say they are an agreement “between you and TikTok USDS Joint Venture LLC.”

CapCut’s US Terms name TikTok USDS Joint Venture LLC as the contracting party, while store listings may show a different seller.

What the US Terms name

The Terms say they apply to United States users. They name TikTok USDS Joint Venture LLC as the other party to that agreement.

What the store listings name

The US App Store listing shows the seller as Bytedance Pte. Ltd., and the Google Play listing shows the same developer, both captured 9 October 2026. We do not know why the listings and the Terms name different companies, and the pages we read do not explain it.

CapCut’s US status, source by source

Four primary sources bear on CapCut’s US status, each captured 9 October 2026.

CapCut Banned claim fact-check vector checklist showing executive order, US Terms, App Store, and Google Play sources
This article checks four primary sources: the executive order, CapCut’s US Terms, the App Store listing, and Google Play.

What the executive order says about CapCut

Executive Order 14352 names “the CapCut applications” in its qualified-divestiture determination, which applies “once its implementation agreements are executed.” The order does not report whether they have been.

What this record does not show

It does not show what happens next, or why the seller name differs from the Terms.

Who owns the joint venture, and how enforcement was delayed

The joint venture’s own announcement of 23 January 2026 says ByteDance retains 19.9%.

Who owns the joint venture

It names Silver Lake, Oracle and MGX as managing investors, each holding 15%, and says its safeguards “will also cover CapCut, and Lemon8.” These are the venture’s own statements about itself.

How enforcement was delayed

Executive Order 14352 says the Act’s prohibitions took effect on 19 January 2025. Four orders then delayed enforcement: 14166 to 5 April 2025, 14258 to 19 June 2025, 14310 to 17 September 2025 and 14350 to 16 December 2025.

What could change CapCut’s US status

We found no order restricting CapCut in the sources checked on 9 October 2026; that describes our check, not the future.

Challenges on the record

NBC News reported that the Public Integrity Project sued in the US Court of Appeals for the D.C. Circuit for two shareholders, naming President Trump and the Attorney General. We have not located the court docket, so we cannot state its date or status.

What officials have said

Senator Markey’s letter of 29 May 2026 says the arrangement kept an operational relationship with ByteDance, “violating the spirit, if not the letter, of the law.” The Office of Legal Counsel concluded on 16 July 2026 that the government-devices ban does not cover the joint venture’s TikTok. Neither document mentions CapCut.

What a change would look like

A new order, a court ruling, a store removal or a Terms update naming another operator would each replace this page’s answer.

Who should still be cautious about CapCut

CapCut’s Terms, last updated 15 April 2026, say: “You should always back up your content.”

If you keep projects in CapCut cloud space

The Terms say cloud space storage capacity is suspended automatically after a subscription term ends. If your projects live only there, copy them out before a plan lapses.

If you edit footage that belongs to a client

The Terms say CapCut does not own your content. They also say submitting it grants the operator, its affiliates and partners an “unconditional, non-exclusive, royalty-free, fully transferable, sub-licensable, perpetual and worldwide license.” Check that against your client contract. Whether CapCut is safe to use for your work is a separate question, covered in the safe-to-use guide.

What to do next if you pay for CapCut

Nothing in the four sources in section 2 sets a date or an action for subscribers.

If you want to keep your plan

Keep it, and keep your projects backed up as section 5 describes. What Pro adds over the free plan is set out in what CapCut Pro pricing buys you.

If you want to leave

The Terms say subscriptions can be paid through an Apple ID account, a Google account or a CapCut account. Which you used changes how cancellation and refunds work, and the guides to cancelling CapCut Pro and CapCut’s refund rules cover each.
