Owner, operator, seller: which one are you asking about?

“Owns” can mean five different things online. This illustration separates ownership, operation, contracting, selling, shareholding, and IP control.

Online, “owns” is used for five different jobs, and CapCut’s documents name different companies for several of them.

The operator runs the service. The contracting company is the one named in the Terms you accept. The seller is the name on the store listing. A shareholder holds a stake in a company. The title-holder holds the rights in the code.

This page records which company each CapCut document names for each job, with dates. It gives no verdict.

What CapCut and the TikTok joint venture say

Who owns CapCut after the TikTok USDS joint venture? Vector illustration showing joint-venture operation and ByteDance minority ownership stake
The joint venture is named as CapCut’s US operator and contracting company, while ByteDance retains a minority stake in the venture.

The US Privacy Policy, last updated 15 April 2026 and captured 10 October 2026, says the Services are “operated by TikTok USDS Joint Venture LLC”. It covers the CapCut app, desktop software and website.

TikTok’s post, dated 23 January 2026, says the venture’s safeguards “will also cover CapCut, and Lemon8”. It also describes its CEO’s role as including business growth for CapCut in the US.

🔍 Why It Works This Way: “Safeguards cover CapCut” describes protection rules. The post does not say CapCut was sold or transferred.

ByteDance’s stake and how we got here

ByteDance’s 19.9% is a stake in the joint venture, not in CapCut.

💵 Verified: ByteDance retains 19.9% of TikTok USDS Joint Venture LLC; Silver Lake, Oracle and MGX hold 15% each. Source: TikTok announcement dated 23 January 2026, retrieved 10 October 2026.

The post names eight further investors without stakes, and calls the venture majority American owned without a percentage.

Both CapCut documents are dated 15 April 2026, 82 days after that post (site calculation). Earlier versions were not captured. CapCut’s 24 June 2025 post about its Terms predates the venture. For ban status, see CapCut’s US ban status.

What would change this answer

Four dated signals would change this page:

  • The “Last updated” date on the US Terms or Privacy Policy (15 April 2026 at capture).
  • A new post changing the shares in the 23 January 2026 announcement.
  • A different App Store seller name (Bytedance Pte. Ltd. at capture on 10 October 2026).
  • A first-party statement on who holds title to CapCut’s code.

The US Terms apply to US users. Our captures resolved to the US documents, so the contracting company outside the US is a gap here.

Who should read the terms before uploading footage

If you upload footage you don’t fully control, read the licence yourself; company ownership does not change it.

The US Terms, updated 15 April 2026, say “We don’t own your User Content”, then grant the venture, its affiliates and partners a perpetual, sub-licensable licence to it.

⚠️ This Costs You: If a client contract limits who may use their footage, uploading it may grant rights that contract does not allow.

✅ Do This: Read the licence section first: what CapCut’s terms say about your videos. On safety, see whether CapCut is safe to use. This is not legal advice.

🧾 Not Tested: No account was created and neither company was contacted for this page. Our captures resolved to the US documents, so non-US wording is not covered. Everything here comes from the pages captured on 10 October 2026.
